REVISED CHAPTER 388-78A WAC – BOARDING HOME LICENSING RULES
Chapter WAC 388-110 - Contracted Residential Care Services
Dear Boarding Home Provider:
After a lengthy process of stakeholder involvement and input, and statutory changes during this past legislative session, a total revision of chapter 388-78A Washington Administrative Code (WAC) - Boarding Home Licensing Rules, has been completed. The revised chapter was filed with the Office of the Code Reviser as Washington State Register (WSR) #04-016-065 and adopted on July 30, 2004. Chapter 388-110 WAC - Contracted Residential Care Services, has also been completed, and was also filed on July 30, 2004 as WSR # 04-016-063. The new rules take effect on September 1, 2004. Provider and staff trainings on WAC 388-78A are currently in progress and will be completed prior to the effective date of implementation.
I would like to take this opportunity to thank those of you who gave your time and expertise in advising the Department of Social and Health Services (DSHS) on the revised WAC chapters. Many residents and their families also took time to comment on the proposed rules, and they definitely have a stake in the final rules and their implementation. All input was carefully considered and in many cases, was incorporated into the final rule. Please share the enclosed information with your resident and family councils, and the residents living in your home.
Chapter 388-78A WAC – Boarding Home Licensing Rules
Enclosed for your information are copies of the following:
- CR 103 (Rule Making Order) form;
- CR 103 - Attachment A: List of sections of WAC that are being repealed;
- CR 103 - Attachment B: Summary of the changes between the proposed and final rule;
- Concise Explanatory Statement (the department’s response to comments regarding the proposed rule);
- Concise Explanatory Statement - Attachment A: List of sections of WAC that are being repealed;
- Concise Explanatory Statement - Annex 1: Department response to additional comments;
- The final rule - Chapter 388-78A WAC; and
- Disclosure of Services, as required by WAC 388-78A-2710(1).
The Disclosure of Services form is available online in both Word and PDF formats. If you do not have Word on your computer, a free download is available on the ADSA website. Using the Word format will enable you to complete the form fields (highlighted gray areas) electronically with information specific to your facility and/or services. You will need to download (save to the hard drive of your computer) the form so the information you add to it can be retained for future use and/or edits. You also have the option to print the form in PDF format and complete it manually.
The final rules and development history, as well as the following related items, can be accessed on the ADSA website at http://www.aasa.dshs.wa.gov/professional/bhrule/default.htm:
- The Boarding Home Administrator training, as required by WAC 388-78A-2540(2); and
- Dementia Screening Tool, optional under WAC 388-78A-2090(7).
The Boarding Home Administrator training is intended for completion online. If you choose to use the Dementia Screening Tool, print a copy and complete it manually.
Chapter 388-110 WAC – Contracted Residential Care Services
- The CR 103 for Chapter 388-110 WAC (the Medicaid contract regulations) has been filed. The final rule will be mailed to you as soon as a codified copy is available.

The online version displays amendments to Chapter 388-110 WAC in the following manner:
- Text that has been deleted/ removed is shown with a strikethrough line
- New text that has been added is shown with an underline
- Entire sections that have been repealed are listed on the last page of the document under REPEALER.
The text of Chapter 388-78A WAC will be published in the Washington State Register on August 18, 2004, and the text of Chapter 388-110 WAC will be published in the Washington State Register on September 1, 2004.
