FINAL RULEMAKING ORDER CR-103 FILED TO CHAPTER 388-110 WAC
Dear Boarding Home Administrator and Interested Parties:
In August 2008 and June 2009, Residential Care Services (RCS) informed you of possible changes to the Boarding Home (BH) Assisted Living Services contract rules. The Department recently filed the final Rule-Making Order CR 103 for amendments to Chapter 388-110-140 WAC, Assisted living services structural requirements in boarding homes, with the Office of the Code Reviser. The rule becomes effective October 11, 2009 and will be published in the Washington State Register as WSR 09-19-042.
The major changes are to:
- Clarify boarding homes must meet the physical requirements in effect at the time the assisted living services contract is initiated;
- Include kitchen sink requirement in resident units that was inadvertently omitted during a previous rulemaking, but has always been required;
- Add language to include kitchen sink minimum inside dimensions in the resident unit;
- Clarify roll-in shower dimensions consistent with licensed boarding home requirements; and
- Clarify rule language and delete unnecessary or redundant language.
A copy of the final rule will not be mailed; however, the CR103 and language revisions can be accessed on the Rules and Policies Assistance (RPAU) web page at: http://www.dshs.wa.gov/pdf/ms/rpau/103P-09-19-042.pdf
Once the codified final (integrated) rule is available, you can access it from a link on the ADSA internet, boarding home professional page at: www.adsa.dshs.wa.gov/professional/bh.htm
If you have any questions or comments about the amended regulations, please contact Judy Johnson, Boarding Home Program Manager, at (360) 725-2591 or by email at johnsjm1@dshs.wa.gov.
Sincerely,
Joyce Pashley Stockwell, Director
