Final amendments to chapter 388-78A
Dear Boarding Home Administrator:
In June and August 2008 Residential Care Services (RCS) informed you of possible changes to the Boarding Home (BH) licensing rules. RCS filed the Rule-Making Order CR-103 for these amendments to Chapter 388-78A WAC with the Office of the Code Reviser:
Respite
Beginning January 15, 2009, new respite care rules become effective. These rules apply to boarding homes that choose to provide respite care. These rules are consistent with Engrossed Second Substitute House Bill (E2SHB) 2668 (An act relating to long-term care), Chapter 146, Laws of 2008. This law created respite care requirements under RCW 18.20.350.
Plan of correction (POC)
Beginning May 1, 2009 new POC rules become effective. Under these rules, if your boarding home is cited for deficient practice, you will be required to sign and date an “attestation of correction” statement for each deficiency cited. You will be attesting that you have corrected or will correct the deficient practice. Although you will not be required to provide the department with a detailed POC you must have a plan for your own use that assists you in correcting and maintaining correction of any deficient practice.
RCS will implement the POC rules after the effective date in May 2009.
Enclosed is a copy of the “Rule Making Order CR-103” and the adopted WAC sections (WSR 09-01-079).
