VOLUNTARY TERMINATION OF MEDICAID CONTRACT
Dear Boarding Home Administrator:
A letter dated April 21, 2008 informed you of a 2008 law about voluntary termination from the Medicaid program. The law included a notice requirement that applies to all boarding homes (BHs) participating in the Medicaid program, not just those terminating from the program.
Revised Code of Washington (RCW) 18.20.440(6) requires boarding homes participating in the Medicaid program to provide oral and written notice to prospective residents before admitting them. The written notice must be prominent and on a page separate from other admission documents. The notice must include the following information:
- In the future, the boarding home may choose to withdraw from participating in the Medicaid program;
- If the boarding home withdraws from the Medicaid program, it will continue to provide services to the following residents:
- Those who were receiving Medicaid on the day before the effective date of the withdrawal; or
- Those who have been paying the facility privately for at least two years and who will become eligible for Medicaid within one hundred eighty days of the date of withdrawal;
- After a boarding home withdraws from the Medicaid program, it may transfer or discharge residents who do not meet the criteria described in this section for nonpayment, even if the resident becomes eligible for Medicaid.
If you participate in the Medicaid program, please make sure that you have added this notice page to your admission agreements. In addition, be sure that prospective residents receive and understand the notice before you admit them.
