CR 101 FILED PROPOSING AMENDMENTS TO CHAPTER 388-78A WAC

Dear Boarding Home Administrator:

The department is considering amending several sections of Chapter 388-78A WAC. 

Boarding homes are currently required to give a 90-day notice to the department and resident when changing ownership.  It was brought to our attention that the length of notice causes unnecessary anxiety on the part of residents, even when the change of ownership would not result in their discharge. 

In addition, the department is considering clarifying the notice requirements regarding enforcement actions and the resident protection program (RPP).

The enclosed CR 101 has been filed with the Office of the Code Reviser to begin the rule making process.  The CR 101 document can also be found on the Internet at:  http://www1.dshs.wa.gov/pdf/ms/rpau/101-08-21-076.pdf.  It is also available on the BH professional page at http://www.adsa.dshs.wa.gov/professional/bh.htm under the heading "Boarding Home Rule Filings".
