ELECTRONIC MONITORING IN ADULT FAMILY HOMES
Dear Adult Family Home Provider:
The revised adult family home (AFH) licensing regulations, chapter 388-76 Washington Administrative Code (WAC), went into effect on January 1, 2008. The chapter includes requirements for electronic monitoring, which put long established standards into rule. However, we have heard that some providers are using electronic monitoring devices in ways that do not meet the requirements. Electronic monitoring devices include but are not limited to video cameras, intercom systems, and baby monitors.
History:
- Requirements limiting the use of electronic monitoring in AFHs have been Residential Care Services (RCS) policy since 1997.
- RCS convened a workgroup in 2002 to discuss the use of electronic monitoring equipment in all RCS licensed facilities. The review included legal interpretations of resident right to privacy and privacy laws.
- The AFH rule, effective January 1, 2008, was updated to include the requirements for electronic monitoring.
- During provider training on the revised WAC chapter last winter we became aware that some providers use of electronic monitoring devices does not meet the licensing requirements.
You Must:
- Not use electronic monitoring equipment:
- For your convenience or in place of adequate and available staff; or
- In common areas.
- Only use electronic monitoring equipment:
- In compliance with sections 388-76-10720 and 10725 WAC; and
- For an individual resident at their request.
